In this case, it seems that both of you don't have a written agreement in hand, so both of you still have the same right and liability on everything. Please also clarify what is seperated? Divorced? and what state you are in? In community stats, all properties are seperated in half, regardless of names of bank accounts. Most northern states, however, are not among this type, but still, if you don't have written agreement of settlement, both of you are entitled to the right and the liability to the house and the loan.
