copyright in U. S? So if we want to import a software from China, that software is already patented in China, but we need to do modification and translation on it?

您可以考慮經由協商成為該公司的北美代理商，你們隻需要負責銷售該公司的產品，至於產品的modification應該有該廠商負責所有的工作. 或是您可以取得該公司"授權發展新產品base on 他們的產品"準許修改他們的產品以應付北美市場的需要，然而不論你們決定用那一種方式，都不能自行更動產品設計without廠商授權，否則該公司可以在北美法院對你們提出訴訟，因為中國為國際保護智慧財產權的簽約國之一，所以美國法院可以對侵害中國專利權的案件作出侵權的裁決，一個有名的案例就是台灣永豐餘公司在美國涉嫌竊取"紫杉醇"的案件，美國杜邦公司在北美及台灣都提出訴訟(不同的 legal ground)，而且在兩邊都贏得勝利，所以您應該小心


do we need to buy the copyright from China company, is it illegal to sell in U. S without buying copywrite from China company? or another scenario, if we just want to be their agent in U. S, do we need to apply patent for the software again in U. S? thanks in advance!!!

至於該產品在美國專利權的申請，應該由該公司自行負責，所以你們如果隻是代理銷售該產品，你們無須擔心專利權的問題
