best time to get divorce

Her moving out is the best way to get divorce. Don't sue her and get into a fight. INS will not sent her back, they might send you back if you are convicted of hitting her.

Try settle with her. Be prepared with the worst: She might call the police, kick you out, get the restraining order, get most of your property, get you pay the alimonly, get you convicted of hitting her and send you back by INS.
