怎樣確認出租房子的人是合法出租？

親戚在紐約上學，夏季需要在曼哈頓找住處。 看到一個很不錯的， 價格非常不錯。下個月中入住。尚未簽約，先付了$50申請費。如果一切是真的，打算直接付3個月的租金。突然想到會不會是騙deposit的那種。。。想請教怎樣才能確定對方是有權合法出租？多謝！
