1. Give owner a call, tell him you are injured and you need his homeowner insurance to pay for the injury. If he rent maybe he has renter's insurance, same thing. Both homeowner insurance and renter's insurance cover liability e.g. wrongful action by the insured.
2. Then give the insurance a call. ask for the following.
- a, out of pocket medical cost. This is easily calculated. Let's say copay etc is $500.
- b. loss of income (time took off work for doctor's visit. your hourly rate x off work. if your time sheet is available it would be helpful. Let's say you have four doctor's visit during work week, your timesheet might show 8 hours, then 8x your hourly rate ~ $800.
- c. pain and suffering: this is usually 3-5 times the medical cost. note this is not your "out of pocket" medical cost, it is the actual cost doctor's office bills to you and your insurance company. This number is available from explaination of benefit (EOB) from your insurance company. The P&S is using medical cost as a basis for calculation.
Let's say you find your EOB for every hospital visits, the total bill is about $1000, you can ask for $5000 (5 times), and negotiate to probably $3000.
3. usually personal injury statute of limitation is 2-5 years depend on your state, so you have some time to finish your treatment and discuss with the insurance company.
