Look up involuntary manslaughter. Such as running a stop sign and killing another driver/pedestrian.
In involuntary manslaughter, there is no requirement of intention to kill as requried by voluntary manslaughter or murder. Laws differ in different states, but involuntary manslaughter usually requires finding of criminal negligence or inherent dangerous activity. Typically it means drunk driving or playing with guns in front of children or in the crowd etc.
So this case, if happened in USA, turns on whether the driver, who kept driving despite a man climbed on his car, was criminally negligent. This determination is also left to the jury. Jury in Oklahoma and New York City might come to different conclusions. So there is definitely a possibiity of finding guilty, but I cannot state the probability since we don't know the details.
