You need to consult a family law attorney in your state. The fact that he is still a Chinese citizen and he moves back to China now makes your case complicated. One major issue in your case is whether the US court has jurisdiction over your hu*****and's property. Another problem is how do you enforce the court's judgment if your hu*****and never return to US again.

In general, if you live in a community property state, you are entitled to not only alimony, but half of his income during your marriage (in some state, the percentage depends on the length of your marriage). If you live in a separate property state, you still can ask for part of his income depending on your contribution to the marriage (not merely monetary contribution). The final decision is within the judge's discretion.
