In general, you are able to divorce your spouse even if s/he doesn't agree.

The duration of the divorce procedure depends on how complex your case is and the case load of the court which has juristidtion over you. If you and your spouse have no disputes as to alimony, property separation, child custody/support issues, it will not take very long for you to get a divorce decree (maybe 9mo to 1.5 yr, depends on where you live). However, if you have all the above issues and your other part doesn't want to collaborate, the case may take longer time to solve.
