1. When does Cancelling check becomes a crime?
Cancelling check itself is not the problem, it's the intent. If the checking account never had enough fund to honor the check, it's simple fraud. Because intent was clear. It's check fraud.
If the checking account had enough fund, then the matter comes down to whether the buyer got what he paid for. If you can show that the good he bought was in good order as advertised, and his cancelling of check is not customer service issue, but simple fraud, the buyer could be charged.
2. Will police get your money? No
But you won't get your money back even if the guy went to jail, you have to sue the buyer individually in civil court.
So I recommend you go to small claim court.
