probation period

My friend was just fired by his school in the probation period. He did an internal transfer on Apr. 1st. he was released on Sep.13th based on 6 month probation period. But the new policy of the school effect on Sep. 1st changed internal transferred employee to 3 months. But HR explained to him his starting date is before September. He thinks he was wrongly terminated. He went to an employment attorney, the firm charged him with $250 and suggested him file a case with $4000. He thinks he should pay the fee after he can win the case. The law firm requested pay first. He is not sure if he can win the case. Is there any good suggestion about the situation? Thanks a lot.
