1. An undiscovered trespasser, you own the duty of refrain from willful misconduct. (not hitting him, or set up trap for trespasser etc) A thief could sue you for stepping into your trap. He could actually win.
2. A known trespasser, such as neighbor or students taking a short cut, you owe an ordinary duty of care of warning of known danger. Which means, you should post notice saying "uneven driveway", and when it snows, "may be slippery with ice and snow" etc. That would satisfies ordinary duty of care of warning.
You should not be liable for anything more.
3. For persons permitted on your land, such as contractors or guests, you owe a higher duty of care, which I am not discussing here.
You should not say "sure, use my driveway, no problem". Then he becomes a permitted person, then you have to pay more attention.
