filing status and forms?

2001年9月J1 researcher來美,2003年11月轉H1B(2004年全年都是H1), 還是在大學
做researcher. 我知道 tax treaty 關於researcher exempt
還適用直到2004年8月底. 困惑的是我2004年怎麽算身份?
1. 全年按RA, but claim treaty for the first 8 months and use form 1040?
2. 8個月按NA, 後麵RA,dual status, and file 2 forms--1040 and 1040NR, and
claim treaty in 1040NR?
3. 全年按NA and use 1040NR. 理由是: 除掉前8個月還剩122天,<183. 所以剩下
的4個月也是NA.如果不能這樣算,錯在哪裏? 當然,即使全年按NA, treaty 也隻適
用到8月,影響不大,我隻是看pub 519看的有點糊塗了,好奇.
