you have two goals, get compensation for damages, and send the dog away.
1. You can sue the owner in civil court, and get compensation. I said earlier it is not going to send the dog away for many reasons.
2. You can have the government issue a ticket for vicious animal, a ticket is a criminal matter (infraction, misdeaminor, not felony) and the criminal court will decide whether the dog is vicious and needs to be killed or reach some agreement to send the dog away.
