Most agents are not going to sue you for a few hundred $. They will sell the check to a collection company. That will file record to your credit. That may make your unable to get low rate when you apply another loan.

If the agent really like to sue you, the court may take two years to hear the case. But during the whole time, you are not able to get any low rate loan. Most lender does not loan money to you if they know your were in such case. If you do not tell the new lender you are in such case. It is a crime. Any fraud in mortgage loan application is a federal crime.
