Lack of lawsuit experience and feeling of guilt was the reason

why this Taiwanese dentist chose this settlement.

If he did not acknowledge his fault in the beginning (most sneaky doctors know how to deny and push away their responsibility), his insurance would not accept your claim of $15000 (or whatever) at all.  It will just end up with a malpractice lawsuit.  To prove his malpractice, you have to resort to authorized dentist or prove his fault.  In dental lawsuit you have to prove 1) the dentist breached the standard of care 2) or applied wrong treatment 3) and finally caused permanent damage.   His case is about infection (assuming that's the whole issue based on what he said).  Infection is a very subtle issue that doctors can easily get away because it involves lot of unknown factor such as personal dental care and oral hygen and activities after the procedure that can NOT be proven to be perfect.  If the dentist accidentally damaged nerve or tooth root during the procedure then it is different story.
