If the dental procedure itself is wrong and causes any permanent damage, that's medical malpractice.  For infection dentist (a sneaky or one with such lawsuit experience) would not admit in the beginning at all.   Your lawyer will have to let you see other reputated dentist to get third opinion to prove the infection was caused by the careless care given by the dentist.  This is almost impossible because infection always happens after the procedure, plus patients have signed the risk consent form.  

I can honestly tell you, if you consult a medical malpractice lawyer, more than 50% chance is they wouldn't take your case at all.
