Neighbors tree broke my fence

Strong wind blowe down my neighbor's tree last week. It fell down in my backyard and damaged my fence and part of the gutter on the roof. Neighbor had the tree cut and cleaned but would not repair the fence and gutter. He doesnot think it is his responsibility. What does the law say, what can I do? I am in long island, New York.
