You are a paid patron of their business. They have the duty to keep the premises safe for your enjoyment. Especially, if this type of theft (criminal activity) happened more than once. Ask the police department about similar incidents. Bally has a duty to take reasonable precautions if it is a known problem. Even if they posted a disclaimer saying they are not responsible, it is not going to stand in a court of law.

The law is likely on your side. However, the amount of money you lost may not worth the trouble and effort to fight it out in court. On the other hand, if you have a strong case, they may want to settle with you.
