After your OPT expires, you have no work authorization and your current employer cannot continue to hire you legally. It is not because you are in breach. On the contrary, it is their breach of the oral agreement of filing H1 petition for you that prevents you from continuing your employment. Since you did not do anything wrong, you would be fine.
