再請教檸檬大俠及有經驗的朋友：一個關於move in/out fee的法律問題

       我的小condo， 兩個月前租給了三個學生，他們三個是一起聯名簽的租房合同，租約1年。他們三個搬進來一個月後，condo association 通過了新的大樓管理條例。從當月開始，每次move in/out fee為$150.  條例中明確規定的move in/out的定義如下：

       Move-in is defined as taking possession of a unit. Move-out is defined as vacating possession of a unit. 

         這個月， 其中的一個學生，獲得一個外州實習的機會，想要搬走，另外兩個學生會繼續留下。請問在這種情況下，一個室友搬走仍然需要向association 交納全額$150 的move out fee 嗎？ 因為隻是一個人搬走，並沒有vacating possession of a unit, 而隻是1/3. 

        就此案例，從法律角度看，我是否有與association 談判move out fee 的空間?  謝謝指點。
