加州的law規定房東21天內必須列出要扣除的費用和退回deposit。

Under California law, 21 calendar days or less after you move, your landlord must either:
Send you a full refund of your security deposit, or
Mail or personally deliver to you an itemized statement that lists the amounts of any deductions from your security deposit and the reasons for the deductions, together with a refund of any amounts not deducted.
房東未能在21天內退deposit和給出扣除費用列表已經違法。我是你女兒就會請律師給他發個律師信要求立刻full refund deposit另加律師的費用。沒回應就對簿公堂吧。加州的law極度protect房客。房東這case沒有defense的。法官基本上會判房東立刻full refund deposit。 而房東因為沒在法定21天內給房客扣除的費用列表,基本法官不會再理會他的理由因為that needs to be done within 21 days。頂多叫房東full refund deposit後另外file case要求房客付扣除費用,不過前提是房東必須full refund deposit first。
Tips:雖然case可以到small claim court,不過SMC要DIY。除非你很懂法律條文,而且很有表達能力,否則請professional吧。
