Basic tax issues

1. Your tax status became resident alien as soon as your H-1 was approved. In your case, you are a resident tax payer for 2002 and 2003 (that means you should file regular 1040 Forms, not 1040 NR forms.)

2. You may elect to be a non-resident taxper (and may have chosen to filed 1040NR Forms) for 2001 because you were under H-1 status for less than 183 days for that year.

3. Whether to file EZ form or the regular form has nothing to do with your resident/ono-resident status. Each 1040NR and 1040Reular forms has a EZ version for people who does not have complicated income sturcture. In you case, the proper question should be whether to file 1040Regular or 1040 EZ Form.
