我有一個手機平板電腦維修服務的生意, 有一天一個顧客拿來一個破損很嚴重手機來修, 我告訴他修不好不收錢,修好後付修理費。我修了一下,手機可以用了, 但是後蓋合不上, 我跟顧客講,我把我的新零件(我付的錢)拿下來,把他的舊零件放上去, 他把手機拿回去找別人修, 我不收他任何修理費, 他給我發了一個短信:
No you have had my phone for weeks now. You have messed up the blue part of my phone and nobody will want to touch it since you have been in it. If someone goes in it who is to blame if it is messed up internally. You are liable until it is fixed. You take it to somebody that you know can fix it. I would have taken it to someone else weeks ago if you had told me you couldn't do it. Don't use my phone to experiment on 。
事實上我以前修好過2個這樣的手機,這種手機是最難修理的,我不同意顧客的意見, 顧客要威脅采取法律行動, 該來的就讓他來吧,我隻好奉陪, 先做點功課。我在GA.
(1)這種案子上什麽法庭?依據什麽法律?
(2)如果我輸了, 最壞的結果是什麽?
我已從這是汲取教訓, 現在所有的顧客都要先簽LIABILITY WAIVER FORM.
