It is not that simple.

It is not as simple as you think if you have the mortgage. Who is on the mortgage? If both of your name is on the mortgage AND the house, even if he deeded the house to you, he is still obligated to pay the mortgage. Why should he deed you the house if he is still responsible for the mortgage.

Talk to an accountant or divorce lawyer.
