Spousal privilege

Spousal testimonial privilege (also called spousal incompetency and spousal immunity) protects the individual holding the privilege from being called to testify by the prosecution against his/her spouse/the defendant.

薄熙來案件，配偶穀開來可以不出庭作證。但是中國法院非常亂，既然人家不出庭作證，你就不能用人家在庭外做的證詞。結果中國法院用了穀開來的證詞，薄熙來要當庭對證，中國法庭卻拿出“配偶可以不出庭作證”為理由，拒絕了薄熙來的請求。這在美國是違反憲法第六修正案的，"in all criminal prosecutions, the accused shall enjoy the right…to be confronted with the witnesses against him."
