鄰居投訴租客生產毒品, 緊急求助---更新

昨天給他發了overnight的信件, 讓他3天內搬走, 信件內容如下:

TO TENANT(S) AND ALL OTHERS IN POSSESSION OF THE PERMISES LOCATED AT:

Address xxxxxxx

PLEASE TAKE NOTICE that you have violated the following terms in your lease and/or rental agreement dated September 01, 2013: page 12, Addendum: Zero Tolerance for Criminal Activity.

I am informed by other residents in the community that you are using my home to develop marijuana inside of the garage. They have witnessed numerous times drug related activities out of the home, and the distinct smell of marijuana all throughout the nights.

PLEASE TAKE FURTHER NOTICE that within (3) days after services of the notice, you are hereby required to quit the subject premises, move out, and deliver up possession of the same to (my name). Failure to vacate the premises WITHIN THREE (3) days as required by this notice will result in forfeiture of the lease and/or rental agreement and will institute legal proceedings for an unlawful detainer against you to recover rent, damages and possession of said premises.

THIS IS INTENDED AS A THREE (3) DAY LEGAL NOTICE FOR THE PURPOSE OF TERMINATING YOUR TENANCY. THIS TERMINATION OF TENANCY IS IN ACCORDANCE WITH CALIFORNIA CODE OF CIVIL PROCEDURE #1161.

LANDLORD RESERVES ALL THE RIGHTS AND REMEDIES PROVIDED UNDER THE RENT AGREEMENT AND UNDER APPLICABLE LAWS OF THE STATE OF CALIFORNIA INCLUDING BUT NOT LIMITED TO DAMAGES FOR UNPAID RENT OR PREPERTY AND NOTHING IN THIS NOTICE MAY BE CONSTRUED AS A WAIVE OF SUCH RIGHTS AND REMEDIES.

然後今天中午他收到後就不停給我電話了, 告訴我他吸食大麻是合法的, 因為他有醫生處方, 他可以給我看所有相關文件。我問他為什麽申請租房時不告訴我他以前被捕的事, 他說那次已經dismiss了。 然後我問他為什麽他名字也和被逮捕時完全不同(照片是一個人)。 他解釋說他結婚後信了別的宗教, 所以改了名字。 難道連姓也需要改麽?

後來他有不斷給我發短信說要和我見麵談一下,他和他家人很喜歡這個房子, 不想搬走。我和他說我需要谘詢法律人士然後再決定怎麽做。

我現在很想讓他很快走人(租約是8月底結束, 但是他說他要再住2年),他不僅申請時有欺騙行為, 而且最近幾個月交租都要催幾次。 4月時告訴我衛生間漏水, 找人修了花450, 在租金裏麵扣了。 看我沒什麽反應, 這次居然說石磚不容易清洗, 打理了一下要1700, 昨天他把租金交了, 但是直接扣除了1700. 我已經和他說了這個沒經過我同意, 以後他不經過我同意不能隨便整修我的房子。

我現在怎麽判斷他是否利用處方過量吸食大麻, 或者用這個借口進行大麻交易? 我用什麽借口可以合法的把他驅逐。如果我不驅逐的話, 我鄰居會不會直接找警察, 這樣的話我會不會有包庇行為?
