I would greatly appreciate if you could shed some light on the following legal matter:
I relocated to the US 10 months ago from Canada. My attorney in Nova Scotia ( Canada) is illegally holding $47,750 from my home sale there.
As of 2013, I had been a NS resident for 8 years before moving to the US, and the house had been my principal residence. My accountant instructed and confirmed that my attorney could withhold 25% net taxable gain for possible tax. The net taxable gain is $49,000, and 25% of it is $12,250. But, my attorney is withholding $60,000 ($47,750 extra).
I am a single mother of a 14 year-old girl. The huge amount of withholding is bringing me financial hardship.
