I bought a tractor (about $900 plus tax) at Sears back in the Summer 2011, but I did not go to pick it up till July 2012. At that time, the store manager did research and found I did not pick it up, and the one I ordered was not available. So he offerred me the one that was available then for the price I paid. He said he would gave me the store credit and then used the store credit to buy it. At that time, I also bought the warranty for about $300. I do have this receipt. Unfortunately, I did not go back to pick it up again till the end of Feb, 2013, mainly because I trusted Sears and also I was busy with my new business. When I called to schedule the pick up in Feb, 2013, Sears told me that I already picked it up in Aug. 2012, which is not true. I went back to store, and tried to explain it. The new store manager stated I or someone from my family picked it up, refused to show me the evidence who picked it up when I requested, and refused to help me by saying I did it again, asked to dispute through my credit company. I called the Customer Service, they stated that this was the second time I did it, and they had positive evident I picked it up. I tried very hard to explain again and again, they won't listen, and I finally had to ask for the evidence to find the truth, but they refuse to show me the evidence!
I bought the first tractor via Visa, and bought the warranty via Discover. I got my money back for the warranty via Discover because Sears issued the credit back, but the Visa company stated they did dispute with Sears, Sears did not respond, and it was too old (2011), so they had to drop it.
The truth is, I did pay about $900 + tax, and now I have no tractor nor money back! Sears refuses to respond!!
Where is the fairness?
Is it too late to sue Sears? How can I do it, please?
