you need evidence and witness to prove the assault; otherwise, he won't be punished. My advice is to call 911 when you get hurted with little evidence, no witness, and reasonable doubt that he doesnt assault you. Why? Because he will be jailed for several hours, but he would not be sentenced if he were not to plead guilty. This is good for both of you...a lesson which has the least impact to his future.
