房屋買賣請教

本人在紐約州，在德州買房。看到一個房子，長話短說，遞交了offer（比如，$35). 德州的交易，一出offer, 就需要買方直接遞交單方麵簽了名的交易合同， 所以我們給了對方這個合同，由我們的簽名，標價$35. 對方counter ($55)，在我們原來的合同上，把$35劃掉，改成$55, 並在邊上initial. 我們收到以後，決定split the difference， 取了中間值counter 回去 ($45),並說明了this is the most we want to pay，並把對方的數字劃掉，寫上了$45, 簽了名字的縮寫. 對方再次counter($50)（again, in writing, with the new number, and 簽了initial) ，我們不同意，說我們不願意付多於$45。他們回來告訴我們， congratulations, 賣方同意了我們的$45, we consider the contract executed， 然後寄給我們對方在我們寄給他們的$45的合同上的簽名。我們沒有再次簽名，沒有date the contract (但是對方put the date on the contract.) 現在我們因為種種原因不想要這個房子了.請問，我們算不算有executed contract? 謝謝。
