landlord has the responsibility to fix the problems in the apartment.  You cannot charge the tenant.  If you charge him/her, he/she can sue you.

(unless you can show sufficient evidence to prove that your toilet was new when the tenant moved in and would never have had any problems but for your tenant's improper or abusive usage.)
