麻煩的是我的租約中沒有提前解約的條款。對方沒有給我任何書麵通知,隻是口頭。
我查到加州關於押金的法律(CaliforniaCivilCode1950.5):“No later than 21 calendar days after the tenant has vacated the premises, ………the landlord shall furnish the tenant, by personal delivery or by first-class mail, postage prepaid, a copy of an itemized statement indicating the basis for, and the amount of, any security received and the disposition of the security and shall return any remaining portion of the security to the tenant.我理解這21天是從房客搬出之日算起,是這樣嗎? 我已早過21 天了,因為還沒找到新房客, 我以為可以用押金抵房租。 至今我和房客之間也沒有正式解約。我的問題: 1. 對方能否用逾期不退押金來告我? 2。我給他發去解約協議,他不理睬,怎樣單方麵解約? 3。在沒有正式解約(書麵)前,我能否和新房客簽約?謝謝!
