You said you had three other witnesses who were also in the car at the time. I wonder if they provided any statements to your insurance company. Depending upon their relationship with you, they may or may not be credible in the view of the insurance company. That does not mean you cannot sue the other driver yourself. You must balance the cost of the witnesses, the legal cost, the chances of whether you can win and recover, the time you would spend, against the damage on your car. It may not be that favorable economically going to court.
