You must consult pertaining NJ family law regarding asset division in such cases.

In California, such request may be approved by a judge. Although a court normally does not like this because it invites more legal disputes in coming years, it could retain jurisdiction to divide the house in a number of years until the child reaches majority. This would also create problems such as how to allocate community property (i.e. marital property in NJ) and separate property. This could happen only when the child is too young and the judge believes selling the house right away would uproot the child. Your agreement with your hu*****and could supersede this.

Obviously this could happen in California and NJ family law could be very different.
