I understand your point.
When dogs play, they bite each other show affection, however bite to attack as well. It is a very hard to tell borderline. My dog likes to jump and play-bite, but never once did she ever hurt any other dogs, definitely not human.
The fact that the owner and HOA can't bring this situation to Animal Control is because they don't have any hard evidence to say my dog was doing anything affending the laws. That's why they want to get back to us by HOA by-laws.
My questinos is what kind of power HOA has, is the rules they laid out for us even lawful?
