There is no such things called joint tenancy for life with remainder. It is either a joint tenancy or life tenants with remainder. But I do agree with you that they need to make the daughter the remainderman to avoid probate and successfully pass the property down to her outright. However, I do believe we need to point out the potential pitfall of the immediate solution to the lady's problem. In estate planning world, there is no perfect solution. Everything you do solves something, but at the same time creates a new problem. In the instant problem, the lady and her hu*****and basically have to give up some control of the property in order to achieve the purpose. A better but more expensive solution actually is to create a living trust.
