we live in CA and invested in several real estate properties in Houston TX. Our old property manager was sick so she recommended us an agent from Remax United. first half year was fine with the new property manager but after August, we always not getting our rent on time, this manager told us that tenant doesn't pay, and when we ask her for eviction, she never done it. sometimes she deposited our money next month after we constantly chase after her. In Oct, she told us one of the tenant only paid 500 instead of full rent of $1495 and she only deposited $500 to us. later we found out from that tenant that paid in full and basically this agent lied and took the rest of the money. Also because we have to chase after her for rents to be deposited to us every month, we were so tired and mad so we gave her notice that we will not using her anymore in November. She never deposited 3 of our November rent check to us and never returned our deposite either (total about $5500). We have been asking her to pay us, every time she said she would but never paid us anything. We had paid a lawyer to wrote her a demand letter but no use. We had talked to her broker - owner of Remax United, they always get her to talk to us us but never done anything. Someone told us it's embazzlement which is crime so we filed complaints to TX real estate commission and General attorny of TX. This manager wrote to us promised us to pay us and have us withdraw all the complaints. We asked her for $3000 for compensation for all the stress and time we spent and lawyer consultation fee. She had in written email will pay us in payments but never paid us till today. We are so tired of dealing with her because she keeps on saying will pay but never paid. we would like to find a good lawyer in houston to file suit in court to get our money back. question is if we should sue her or the Remax United? and if we could sue for compensation too? Would anyone know a good business litigation (breach of contract) lawyer in Houston? much appreciated!
