I would say most states, if not all, afford some type of protection for the surviving spouse, meaning that regardless whether there is a will or not or what is stated in the will the surviving spouse would be entitled to a decent pecentage of the estate. For example, in New York the surviving spouse is entitled to at least 1/3 of the estate.
