Think it this way: that suit may be the reason the offer looks good. Without knowing the details of the lawsuit nobody knows whether it has merit even though it sounds frivilous. But even if the suit has no merit, you have to deal with it by investing lots of time and efforts, possibly attorney fees and time. If owner B attaches you as the defendant and wins against you, you may have to file another claim against owner A for breaching one of the covenants. Nobody wants to buy into a lawsuit and that may be the reason previous buyers were gone. If you do not mind about potential legal headaches down the road and must buy it, make sure owner A gives you a general waranty deed, not a quit claim deed or a special waranty deed.
