advantage to settle property in probate court than in family?

if one spouse will die soon in middle of divorce, better to settle in family court before death or to settle in probate court? Whhic way is easier and cheaper?

he had transfered community house to his trust account, or to his brother. How to fix this in county record since it is agaist the law during pending divorce. His attorney sent letter stating he intends to terminate joint tendancy He owes $100k child support.

Will probate or family court grant entire community proerty to surviving spouse and kids for the fact of his death ( He no longer need money) and the fact of his illegal transfers and child support arrors?
