原則上法律保障現在的配偶與親屬,同時原則上法律是保障當事人的自由意誌,所以如果你們的離婚程序在他過世之前完成,你可能會有一些麻煩得到您想要的. 至於你們的孩子的部份,原則上在他過世之後法律隻能保障你們配偶雙方的權益不因為他個人的決定而受到不公平的待遇,所以你們的孩子與他的父母在法律上是有同等的地位,也就是說法律上不可能說給與你們的孩子任何特殊的待遇. 因此法官可能無法推翻他的決定如果對方做出這個決定時身心都仍然有行為能力.
