what should I do now?

Hello,
I recently moved out of my apartment, and I asked my landlord give me back my deposit check, even he did not deposit it.
First, he said, he was very busy at the time, he could not give me. So I said I could call him later.

Then I called him few days later, he said still he was busy, and he was willing to mail it to me before september 15. He said he is trustable.

Few days ago, (now it is already Oct. 8), I called him again, he said he did not deposit my check, and I should stop the payment of the check. I answered him I had to pay $30 charge to stop payment, I am not willing to pay that, I just want my check back. Then he cursed, and said he can not find the check, and he was not going to give it back to me, and hang up the phone when I still tried to talk.

I am very upset and angry to him.

If I let him keep the check, I am afraid in the future time, he may deposit the check when I move out the city. He is not trustable actually.
At the same time, I don't stop the payment because I think landlord should take responsiblity for my loss.
And also I think he behavior so badly, I don't want let him go so easily.

What should I do? can I sue him for refusing return my check or deposit?
