原則上＂通奸＂在德州並不是一項＂現存的＂犯罪的行為,（過去是,但是在 1892　年之後就沒有人再被起訴過）,　然而德州家庭法 § 6.003 中有規定,ADULTERY. The court may grant a divorce in favor of one spouse if the other spouse has committed adultery.
所以就是說如果他的先生日後在德州的法院訴求離婚時使用這個原因　as grounds for divorce,在麵對其他問題時,法官很有可能會保護您的朋友先生的權益.


然而因為德州是 no-fault state 所以個人會建議您的朋友考慮在其先生仍然在中國時立即提出離婚,然後協商是否有可能均分雙方的財產. (TX 是使用community property)


有關 community property　的定義如下

§ 3.002. COMMUNITY PROPERTY. Community property
consists of the property, other than separate property, acquired by
either spouse during marriage.
