You can hire him. But you need pay his salary, H1B

fee, etc. He can't pay by himself. USCIS may come to your company and ask him what he is doing, Pay stub, W2 etc. They are increased on site visit. You do need realy hire him. Like you hire someone else. Or it is a fraud. You are both in trouble.
