In New York, you can have a divorce one year after either a seperation agreement or a seperation decree. This is called conversion divorce. However, there must either be a seperation agreement between the parties or a seperation decree from the court. Being physically apart doesn't do it, unless it can be treated as abandonment, which is another story.
