It is not a good idea

no parents want to be told that their kids have problems and need to be seen by doctors even it is the truth. I live in Canada too, my daughter's school has an anti-bully program called: WITS, it is walk away, ignore, talk it out and seek help. For your situation try the first two first. 

Two more things you can try, change the time for your kid's swimming class to avoid being in the same class as the other boy, and when you register for K, ask for not being in the same class as that boy, usually the school will take it into consideration if a good reason is provided.
