urgent question

I filed my green card for nurse immigration last year.Before i filed my green card,i was holding the H4 visa,and valid untill 2007.But i am stuggling with the English test now,i could not pass the TSE.SO i want to join to my hu*****and's NIW case,he will file his petition this month.What is the procedure for me to join to his case?I asked my lawyer, she said if my green card were denied ,i will automatically go back to H4 visa without go back to china to reapply,because my H4 visa still valid,but i got the information said i should go back to China to reapply H4, because i use the EAD from USCIS basic on my case.Which one is correct？What should us do to keep the valid status in USA?
