Basically it depends on how you define what contents in your letter and how you organize your materials. Generally, if you put all all the information in one letter, you can think they are same. I have seen most people do in this way even if some lawyers do the same way. If you want to separate them, say, petition letter just used for descrpition of NIW three criteria, and cover letter to address other issues, then you can say they are different.
