Can this H1-B be approved?

My current wage can't match the prevailing wage and my attorney found a private survey with much lower wage level. This private survey has been accepted by the Department of Labor, but the paper file has not submmited to USCIS yet. Can my H1-B be approved with this private survey?

If any DA-XIA has similar experience or relative knowledge, please give advise.
