I guess your hu*****and probably got his J1 visa in a third country, of which citizens are not subject to 2-year home country residency. That's the reason why your hu*****and's visa was not annotated a home country residency requirment because US Embassy or Consulate in that country never issue a visa with such annotation.
But unfortunately,this only applies to the citizens of that country, not for others, even PR of that country. All of us holding Chinese (PRC) passport are subject to this requiremnet, no exemption. No matter what was annotated in the visa, you hu*****and must get a waiver if he or you want to change your visa status.
